How UAE gratuity is calculated
Under the current law, every private-sector employee who completes at least one year of continuous service is entitled to end-of-service gratuity, calculated on basic salary only (housing, transport and other allowances are excluded):
- 21 calendar days' basic salary for each of the first five years of service.
- 30 calendar days' basic salary for each additional year beyond five.
- Partial years are paid on a pro-rata basis.
- Total gratuity is capped at two years' total salary.
- No gratuity is due for service under one year.
What changed in 2022
Earlier UAE labour law reduced gratuity for employees who resigned from an unlimited contract before five years of service. Federal Decree-Law No. 33 of 2021 removed that distinction: since it took effect, the same formula applies whether the employee resigned or was terminated, and regardless of contract type, except in the narrow disciplinary-dismissal cases set out in Article 44.
What this calculator does not cover
This tool estimates the standard gratuity entitlement only. It does not account for unpaid leave that extends your service period, end-of-service adjustments for part-time or unpaid probation, disciplinary dismissal under Article 44, or free zone entities (such as DIFC or ADGM) that run their own separate employment regulations.
Frequently asked questions
Do I get gratuity if I resign?
Yes. Since Federal Decree-Law No. 33 of 2021 took effect, resignation and termination are calculated the same way, provided you have completed at least one year of continuous service.
Is gratuity calculated on my total salary or just my basic salary?
Basic salary only. Housing allowance, transport allowance, commission and other benefits are excluded from the calculation.
Is there a maximum gratuity payout?
Yes. Total gratuity cannot exceed two years' total salary (24 months), regardless of how many years you worked.
Do free zones like DIFC or ADGM use this formula?
No. DIFC and ADGM operate their own separate employment regulations with different gratuity or pension rules, so this calculator does not apply there.
